Weissbeerger Ltd. is committed to your right to privacy. This privacy policy applies to information collected via our internet websites at www.weissbeerger.com or www.beverageanalytics.uk (each referred to as the “Site” or a “Site”) or the Weissbeerger Ltd. Beverage Analytics mobile application (the “App”), and/or the services available through the Site or the App or otherwise provided by Weissbeerger Ltd. (the “Services”).

The terms the “Company” or “we”, “us” or “our” when used in this Privacy Policy mean Weissbeerger Ltd., our parent and any of our or its affiliates.

The terms “User” or “you” when used in this Privacy Policy mean any user of the Site the App and/or Services (as defined in our Terms of Use).

We value your trust, and therefore strive to present you this policy in clear, plain language, so you can quickly find answers to the questions that interest you. If you choose to register or submit information to the Site and Services, you agree to the use of such data in accordance with this Privacy Policy.

Please note, that the Services may contain links to other websites maintained by third parties, which may not be governed by this Privacy Policy. Company is not responsible for the privacy practices or the content of such websites. Users are advised to check the privacy policy of each third party website into which they enter.

Terms not defined herein shall have the meaning ascribed to them in our Terms of Use. In the event of a contradiction or discrepancy between this Privacy Policy and (a) our Terms of Use, and/or (b) a specific Services Agreement entered into between you and Weissbeerger Ltd. (a “Services Agreement”), then the Terms of Use or the Services Agreements, as applicable, shall prevail.

  1. Information Collection

We log visitor’s domain and IP address automatically; this information only identifies the device that is being used to log in to the Site and/or the App. We also use cookies (small text files stored in a user’s browser) or Web beacons (electronic images that allow the Site and/or the App to count visitors who have accessed a particular page and to access certain cookies) to gather personally unidentified information. You may at any time program your browser to block cookies, but be aware that such blocking may prevent us from providing some or all of the Services to you.

We collect only personally identified information that is specifically and voluntarily provided by you, for example, if you provide us with an email address and company’s name in order to receive initial information regarding your website, or other login information you provided while registering for an account as a client of the Services. If you choose to register or submit information to the Site and/or the App, you agree to the use of such data in accordance with this Privacy Policy.

We may store your personal information as long as it is necessary or relevant for our Services. We may also retain personal information from closed accounts to comply with any law or regulation, prevent fraud, collect fees, resolve disputes, troubleshoot problems, assist with any investigation, enforce our Terms of Use and take other actions permitted or required by applicable national laws.

Non-personal information is used mainly for click stream analysis in order to constantly improve and maintain our Site and/or the App and the Services, including among others, for ensuring the technical functioning of our network, to help prevent fraudulent use of our services and for developing new services. In addition, the web master may, where necessary, use unidentified information for various Site and/or App related tasks.

Personal information is used only for limited purposes. We may use personally identifiable information that we have collected about you in several ways, including in order to manage and administer your account, to process and fulfill the transactions you initiate, to identify you on the Site and/or the App, to respond to your questions or comments, or to inform you of material changes or additions to this Privacy Policy or our Terms of Use.

We may also analyze traffic patterns, users’ demographics and behavior, for general business analytics and in order to provide you with a more personalized experience.

  1. Sharing of Information with Third Parties

We may share non-personal, aggregate information regarding the Site and/or the App usage with our affiliates or partners. From time to time, we may release non-personally-identifying information in the aggregate, e.g., by publishing a report on trends in Company usage.

We may share users’ personal information with our partners or our affiliates to facilitate the delivery of the Services and as necessary to allow you to enjoy the Services. Furthermore, we may disclose users’ personal information to third parties, solely when we believe that such disclosure is required for us in order to provide you access to our Services, to comply with our legal obligations, to enforce our Terms of Use, to facilitate our marketing and advertising activities, or to prevent, detect, mitigate and/or investigate activities related to our Services that are fraudulent, illegal or in contrast to our Terms of Use. We do not disclose your personal information to third parties for their marketing and advertising purposes without your consent.

Following your acceptance of our Terms of Use, we may share specific User data by site (bar/restaurant) with beverage companies and/or our other partners, including, without limitation the User name and ID, performance milestones, sales volume, revenues, and information of such sort.

 

  1. Access to Information

We take reasonable security measures to protect Users’ information against unauthorized access to or unauthorized alteration, disclosure or destruction of data. However please note that the Site and/or the App, as with most Internet websites and/or the mobile applications, is vulnerable to various security issues including without limitation various eavesdropping, electronic trespassing, sniffing, spamming, nuking, hacking, spoofing, “imposturing”, breaking passwords, harassment, fraud, forgery and system contamination including without limitation use of viruses, worms and Trojan horses causing unauthorized, damaging harmful access and/or retrieval of information and data on the User’s computer and/or cellular phone or the User’s information and data on the Company’s servers and other forms of activities that may even be considered unlawful, and hence should be considered unsecured. Information and data may also not reach their destination or reach an erroneous address or recipient. Also note that no data transmission over the Internet can be guaranteed to be absolutely secure. In the event of a breach of the confidentiality or security of your personal information, we will reasonably attempt to notify you as necessary so you can take appropriate protective steps. We may notify you under such circumstances using your most current email address on record with us. We reserve the right to use or disclose personal information to law enforcement, regulatory or other government agencies, or third parties if we reasonably believe that use or disclosure is necessary to protect Company’s rights and/or to comply with a judicial proceeding, court order, or a legal process.

  1. Assignment

If Company elects, in its reasonable discretion, to transfer ownership or control of the Site, the App or Services to a third party, whether or not in the context of an acquisition, merger, or reorganization, you consent to the transfer of your personally identifiable information and non-personally identifiable information by Company to that third party, provided that all use of your information by that third party remains subject to the terms of this Policy.

Company reserves the right to modify or amend this Privacy Policy at any time and for any reason.
